Your authority

Can Confluence ministers officiate in Tennessee?

Tennessee Code Section 36-3-301 allows ministers, preachers, pastors, priests, rabbis, and other spiritual leaders who are over 18 and have the care of souls to solemnize marriages. A 2019 amendment states that people who receive online ordinations may not solemnize marriages.

That 2019 provision has been challenged in federal court, and its enforcement has been blocked in some counties while the case continues. Because Confluence ordination is earned through online study, a Confluence minister officiating in Tennessee faces legal uncertainty.

Step by step

Performing a wedding in Tennessee

  1. Get ordained

Complete the $100 Ordination Orientation to receive your ordination.

  2. Talk with the couple about the legal side

Explain that Tennessee law on online ordination is unsettled. The safest choice is for a county clerk, judge, or other public official to complete the legal marriage, before or after the ceremony you lead.

  3. Lead the ceremony

Lead a ceremony that is meaningful to the couple. Your role as their minister is real, whoever signs the license.

  4. Make sure the license is returned

Whoever signs the license must return it to the county clerk within 3 days of signing.

Details and exceptions

  • Until the courts settle the question, we recommend that Confluence ministers in Tennessee lead the ceremony while a public official signs the license.
  • Clerks sometimes have their own questions or procedures. Contact the office that issues the license if you are unsure about anything, and confirm the current rules before every wedding, because laws change.
